AGENDA ITEM 1 CALL TO ORDER/ROLL CALL:

The special meeting was called to order by Mayor Young at 7:30 p.m.

A quorum was present and due notice had been published.
AGENDA ITEM 2 PUBLIC HEARINGS:
Public Hearing: The purpose of the hearing is to obtain public input related to an appeal of three conditions of approval included in the Planning Commission’s approval of a preliminary plat for a 41-unit subdivision. The request is for reversal or modification of Final Order Condition No. 1, 2 and 5. The subject property, consisting of approximately 13 acres, is located north of "A" Street, east of Sixth Street, south of Pacific Street and west of Highway 30 in Columbia City, and is described as tax accounts 5121-000-426, 5121-031-2600, 5121-034-3000, and 5121-034-3101. The property is zoned R-1, Single Family Residential. The applicant is Jim Smith, Civil Engineer, the property owner is Wayne Weigandt, and the agent is Dorothy S. Cofield, Attorney at Law.
Mayor Young opened the public hearing.
Mayor Young announced that, at the request of the applicant, the public hearing would be continued to May 3, 2001, 7:30 p.m., and will be held in the City Hall Council Chambers.
AGENDA ITEM 3 ACTION RELATED TO PUBLIC HEARING: None.
AGENDA ITEM 4 EXECUTIVE SESSION: The City Council met in Executive Session in accordance with ORS 192.660(1)(f) to consider records that are exempt by law from public inspection and in accordance with ORS 192.660(1)(h) to consult with legal counsel concerning litigation likely to be filed.
The Council convened in Executive Session.
The Council reconvened in Open Session.
MOVED (HUDSON), SECONDED (GUY) AND CARRIED UNANIMOUSLY TO AUTHORIZE THE MAYOR TO SIGN THE AGREEMENT PENDING ADVICE OF COUNSEL AND PENDING VERIFICATION OF OWNERSHIP OF LAND AS WE UNDERSTAND IT.
