ORDINANCE NO. 16

AN ORDINANCE establishing two permanent points of survey within the City of Columbia City, Oregon, and providing a penalty for the destruction thereof.

WHEREAS the Initial Point of the City of Columbia City, Oregon, which said Initial Point is the Northeast corner of the Joseph Caples Donation Land Claim in Columbia County, Oregon, is inaccessible and at times entirely covered by the waters of the Columbia River, and great inconvenience results from the inability to make use of said point at such times;

AND WHEREAS the said City is now rapidly developing and there is much demand for the establishment of permanent, convenient and accessible points within the City which may be used by surveyors, engineers and others in public and private employment, in the establishment of street and property lines and grades;

AND WHEREAS the City of Columbia City has heretofore employed L. J. Van Orshoven, County Surveyor for Columbia County, Oregon to establish within the City two permanent monuments to be used in all surveying and engineering work therein, which said monuments are constructed of cement imbedded in the ground to a depth of approximately two feet, and each being approximately one foot in diameter, in each of which is set a copper pin about eight inches in length, marking the respective points hereafter described, one at the center of the intersection of Second and "G" Streets, and the other at the intersection of Second and "K" Streets; which said points are more definitely described as follows, to-wit:

Commencing at the Initial Point of the City of Columbia City, in Columbia County, Oregon, which said initial point is the northeast corner of the Joseph Caples Donation Land Claim, in said Columbia County, Oregon, and running thence S. 66 Deg. 36’W, 722.842 feet to a point; thence S. 17 Deg. 21’ 12" E., 678.03 feet to the first point or monument herein referred to, at the intersection of 2nd and "G" streets; thence S. 17 Deg. 21’ 12" E., 1520 feet to the second of said points or monuments, at the center of the intersection of 2nd and "K" streets;

AND WHEREAS the Common Council is satisfied that the said points have been well and carefully set and located, and in full compliance with the orders and directions of the said Council:

NOW THEREFORE: THE CITY OF COLUMBIA CITY DOES ORDAIN AS FOLLOWS:

Section 1. [Permanent Survey Points.] The said two monuments and points heretofore herein described shall be and the same are hereby established as permanent points of survey within the City of Columbia City, Oregon; and all surveys made for or by the said City or the citizens thereof may commence at said points or either of them as initial points of survey within said City.

Section 2. Penalties. Any person or persons who shall in any manner mutilate, move, change, alter or destroy, or who shall attempt to mutilate, move, change, alter or destroy the hereinbefore described monuments or points, or either of them, shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not less than $100.00 and not more than $500.00.
