ORDINANCE NO. 07-640-O
AN ORDINANCE PROHIBITING COMMERCIAL VEHICULAR TRAFFIC ON A
PORTION OF "I" STREET, FIFTH STREET, AND "J" STREET; AND
ESTABLISHING A PENALTY.
WHEREAS,
the Common Council of the City of Columbia City deems it necessary to adopt
certain restrictions on the use of "I" Street between Highway 30 and
Fifth Street, Fifth Street between "I" and "J" Streets, and
"J" Street between Fifth and Sixth Streets, in order to reduce damage
to the streets and enhance the safety, protection and general welfare of the
public, NOW, THEREFORE,
The
City of Columbia City ordains as follows:
Section
1. Definitions: As used in
this Ordinance, unless the context otherwise requires, words and phrases shall
have those definitions as set forth in ORS Chapter 801.
Section
2. [Declaring certain streets closed to commercial traffic.] The following streets are hereby declared
closed to commercial vehicle traffic except for the reasonable and necessary
delivery of goods or services to properties within the closed area:
a. "I"
Street between Highway 30 and Fifth Street.
b. Fifth
Street between "I" and "J" Streets.
c. "J"
Street between Fifth and Sixth Streets.
Section
3. [Posting of signs.]
The Public Works Department of the City of Columbia City is hereby
authorized and instructed to install the appropriate signs prohibiting
commercial vehicular traffic in the sections of City streets described herein.
Section
4. Classification and Penalty: Any person
violating this Ordinance is guilty of having committed a Class D traffic
infraction and shall be punished as provided by Oregon Statute for violation of
a Class D traffic infraction.
